Imrana case

Recently the Imrana case was making news in the papers and followng her lead many other similar cases came to light. I feel this is a shame to the muslim society. The shariah courts when issued the fatwa on Imrana to get a separation from her husband should also have stoned the father in law to death. Why should Indian Penal Code be applied to the beast alone? (Muslim personal law is another issue but im not knowledgeable enough about it to talk on that). Whether the couple gets a separation or not is their decision. I think they should be left alone. And at the same time, FIL should be sentenced to death. I believe rape does deserve a death sentence as in case of a murder the victim at least dies and thats the end of it. But the rape victim lives with the trauma all her life. A murder can be a spur of the moment thing but a rape is a deliberate act.
When I discussed this case with somebody I was shocked to hear him say that this issue should have been resolved internally and this shouldn't have been brought out in the open! A crime like that should be unreported!! To save the pride of the community !! The community is very hollow if it really hides its skeletons this way.
Inspite of all the preaching I hear from people, I believe that the muslim clergy is taking the society 1500yrs backwards. It has a great potential. It can mobilise masses. The prayer congregations can be used for the betterment of the society. Instead, the bayaans I hear second hand from my father tell me otherwise. So if the clergy wishes the best for the society, they can start by preaching the empowerment of women. Women in prophets time had a better (or rather the best ) status than what they have now.

In the same breath, I say that women are being oppressed not only in my religion but in others too and others need not use this for finger pointing. Like a teacher tells us so often- clean your own 1 square area ( without dirtying the neighbours sq. area :-D) and its ensured that we will have a cleaner place to live in.

Sorry for the serious tone of this post. I'll get back to my movie reviews next post onwards :-D

noemaunn yes I did. I did read through second hand sources what Islam says about these things. And as much I learned from my Islamic books, I feel that many hadiths of Prophet are meant to make life simpler and easier to live. They are just and are meant to bring peace and barkath in the community. They have been issued to eradicate the evils in the society.
But the dictums issued these days dont even appeal to the common sense.
Well u too know how our Indian courts work. The accused most of the times gets out cos he finds some loophole or other in the laws. So 'innocent until proved guilty' works more in favour of the criminal than the victim. But then U know this. Its just that u prefer to look away rather than admit that the man was guilty.
I personally feel that if a lady says that she has been sexually abused it must have been true. If she only had to get the FIL into trouble, she could have framed some other lighter charge like dowry harassment.

But Im disappointed that educated people like you doubt the victim rather than the accused. This is often the case with all the rape cases in India as we all very well know and hence the victim doesn't get justice in most of the cases.

Your own argument doesnt make sense wrt this case at all. If the accused was not guilty the fatwa also should have not been issued

Phew!!! The heated arguments for this particular section are so hot that itz making me sweat ( even though i am sitting in tha AC room right now)!

the reasons i am sweating are two folds : a) okie this is my confession, I have no clue what this imrana case is all about so that does kinda nullify anything i have to say about it and b) not qualified enough to judge the writings of islam!

yet i shall put in what i feel like coz people have to accept the fact that anybody and everybody eventhough being a nobody has a right to say anything, everything and nothing!!!! :D ( so Mr. Neuman grow up and deal with it!)

like it or not the advise given by some people that the matters should be solved internally in rape cases without bringing brining it in open is the MOST PRACTICAL ADVISE! although it does not mean that itz the right thing to do. as a matter of fact most women do resort to this after whatever has been done has been done! coz as the Authoress herself quoted that life goes on for the victim and is it wrong if she still dreams to lead a normal life! is it wrong if she thinks of herself ignoring the community! i really dont think so!

it takes guts to openly state that a wrong has been done and one has to be really be strong enough to bring it out in the open coz once itz out there is no going back! she would have to live up with the sneering looks even from low lifes in her locality for the rest of her life! in fact the thugs take advantage of the very same thing knowing that to avoid embarrasment, the victim rarely brings it out in the open!!!! thats why i would commend those women-of-steel who brought it out in the open and still be understanding towards those who remained silent!

moving on to the pointing fingers...
i do recall a funny incident here! itz suprising how many different speciemens e come across by just sitting down and sipping coffee ( or going thru ur friends blog!)so there is this Btech guy who is delusional enough to want to be the modern raja ram mohan rai and liberate the women! he was strongly against the purdha system and said that he would make sure itz gone! now let me add that he is as qualified enough as i am to have a say in anything in that regard and my very first thoughts on hearing what he wanted to do was "Pitega S@#la". I honestly replied to him that why does he want to poke his nose where he doesnt belong!i asked him what was so WRONG in them wearing burkha and he said that they were not liberated enough and i asked him dude! how liberated do you think our women are who are supposed to wear white after thier hubies death! why dont u start from there...for which he stil hasnt answered me yet!

suprising aint it how easy itz to spot and point others while turning a blind eye to ourselves! :D

World is not BLACK or WHITE eveywhere but different shades of GREY!!! one just has to pick the colors which suit them the best and move on!!!!

Before I begin slandering, let me clarify on a few aspects. A fatwa in this case is a legal advice and not a judgement. Here the fatwa states what should be done if the accused is found guilty.

As a civilised society we do not assume that the accused is guilty unless it is proven in the court in accordance to the rule of the land. Whether the accused committed a crime or not, is yet to be identified but surely you have committed a blatant mistake. You can't forget your ethics just because something wrong or evil has taken place. You may be sympathising with a probable criminal but that does not mean that you are supporting the crime. To feel that such a basic law of humanity goes against the victim symbolises your lack of trust in the judiciary and the law and order of the land. May be you have seen too many movies.

You continue to assert your statement with feminist ideas that a lady can not make a false accusation on such critical issues. Little do you know that statistically 90%(a recent report by city police) of reported cases are often false or exaggerated. Ever wondered how soo many professors in our institute have a long list of sexual harrassment cases against them?

To say that people have the right to say anything, everything and nothing is not libertarian but libertine. This is the attitude amongst youth who are yet to identify the real pleasure in life.

OK so dear noemaunn if u dont agree with my views, stay away. Like I said in my first post these are my own views and if they dont go down well with somebody they are welcome to keep away from my blog.. This is in response to ur comment in the last para..
And referring to the institute comment, have u ever realised why a need for women's forum was felt in the Institute. I think u better go check out b4 making crass statements like that. Well I think that statement qualified as a slander.
Indian Justice laws are very good. Its just that it has "loopholes" in it which can be easily manipulated by a competent lawyer. And one can go check out just how many cases are pending in the courts to see this.
And in many ways movies are a reflection of the society. So if you have something against them, it doesn't mean that everything in movies is fiction and fantasy.

I have so far avoided personal comments on anybody on my blog. But I just couldn't restrain myself. Hope this is the last time too.

Noemaunn as much as I have known about you from ur views on orkut and a few personal interacts, I have always felt - this guy is just out of school and he has such rigid views on everything. He has had a sheltered life with little experience of any of the harshness some millions of people face in this country. He still has to see life yet he believes he that he is the know-all on everything. I dont say that I have faced any of the realities but then I don't pretend to be a know-all either. I will say its good to have opinions but dont form them on prejudices. See and think for urself and then form opinions. It helps to be a bit flexible in life.

To talk about youth without even getting through the best part of it sounded hilarious to me.

As an aside, on the topic of youth and age and in no connection watsoever to the topic under discussion, a wise quote by Prof. Dumbledore (:-D) "Youth cannot know how age thinks and feels. But old men are guilty if they forget what it is to be young."

And finally, your advices to me are not welcome. The new girls can take care of themselves and there are others who will do what u ask on their own. This is fyi that I don't pay heed to such instructions so please preach to people who will hear you, not me.

apart from this blog, it makes me feel dejected that you turned down my request in the right cause with the right intention. All I asked you was a simple favour which would not have taken more than half an hour. If you know for sure that someone else is doing it, then it is well and good. That was not an advice from a 'just out of school' rogue like the posts above, but a request from a fellow muslim brother.

most of the other guys who used to do it over the years have left IIT and there is too much of infighting in the yahoo groups that we aren't able to decide anything. God willingly, i ll go all out on my own even if noone is willing to help me.
